Terms of Use

1. Acknowledgement

These Terms are an agreement between you and CSW Ventures LLC ("PourMe," "we," "us") only, and not with Apple Inc. We alone are responsible for PourMe and its content. Your use of PourMe must comply with the App Store Terms of Service.

2. Eligibility

PourMe is intended for people of legal drinking age in their jurisdiction — 21 or older in the United States. By using PourMe you confirm you meet that requirement. We do not knowingly permit accounts for anyone below it, and we will remove any we find.

PourMe is offered in the United States. It is not available in the European Economic Area or the United Kingdom.

3. Your account

Accounts are created through Sign in with Apple. You are responsible for activity under your account. Do not share it, and do not create an account for anyone else.

4. Scope of license

We grant you a personal, non-transferable, revocable license to use PourMe on Apple-branded devices you own or control, as permitted by the App Store Terms. You may not copy, reverse-engineer, resell, or redistribute the app.

5. Community conduct

There is no tolerance for objectionable content or abusive behavior on PourMe. When you post publicly, you agree not to submit content that:

• Harasses, threatens, defames, or impersonates anyone.
• Is hateful toward a person or group, or promotes violence.
• Is sexually explicit, obscene, or gratuitously graphic.
• Promotes dangerous drinking, drinking by minors, or drinking while driving.
• Is spam, advertising, or an attempt to sell alcohol or any other product.
• Infringes anyone's intellectual property or privacy.
• Is unlawful, or facilitates anything unlawful.

6. Moderation, reporting, and blocking

You can report any review, photo, comment, or user directly in the app, and you can block a user to stop seeing their content. We review reports and remove violating content or terminate the responsible account within 24 hours of a report.

We may remove content or suspend accounts at our discretion, with or without notice, where we believe these Terms have been broken.

7. Your content

Your bottles, reviews, notes, and photos remain yours. By posting content publicly you grant us a non-exclusive, royalty-free license to host, display, and distribute it inside PourMe for the purpose of operating the app. That license ends when you delete the content or your account, except for copies already made by other users or retained in backups for a limited period.

You are responsible for the content you post, and you confirm you have the right to post it.

8. Maintenance and support

We provide support at steven@cswventuresllc.com. Apple has no obligation to furnish any maintenance or support services for PourMe.

9. Warranty

PourMe is provided "as is" and "as available," without warranties of any kind to the fullest extent permitted by law. If PourMe fails to conform to any applicable warranty, you may notify Apple, and Apple will refund your purchase price if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to PourMe. Any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are our sole responsibility.

10. Product claims

We, not Apple, are responsible for addressing any claims relating to PourMe or your use of it, including product liability claims, any claim that PourMe fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or similar legislation.

11. Legal compliance

You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.

12. Intellectual property

If any third party claims that PourMe infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement, and discharge of that claim.

13. Third party terms

You agree to comply with applicable third party terms of agreement when using PourMe — for example, your wireless data service agreement.

14. Third party beneficiary

Apple and Apple's subsidiaries are third party beneficiaries of these Terms. Upon your acceptance, Apple has the right — and is deemed to have accepted the right — to enforce these Terms against you as a third party beneficiary.

15. Limitation of liability

To the fullest extent permitted by law, CSW Ventures LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising from your use of PourMe. Nothing in these Terms limits liability that cannot be limited by law.

16. Drink responsibly

PourMe is a record-keeping and social app. Nothing in it is a recommendation to consume alcohol, and none of it is medical advice. Please drink responsibly and never drive after drinking.

17. Termination

You can end this agreement at any time by deleting your account in Settings → Delete Account. We may suspend or terminate your access if you break these Terms.

18. Changes

We may update these Terms. When we do, we will change the date at the top of this page. Continuing to use PourMe after a change means you accept the updated Terms.

19. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules.
